Welcome and thanks for using Magnet.me! These Terms of Service contain the terms and conditions that govern all use of our Platform and Services.
Please read these terms carefully. By registering for, accessing, browsing and/or otherwise using the Magnet.me Service, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to be bound by these Terms, do not access, browse or otherwise use the Platform or Service.
The mission of Magnet.me is to make it easier to find a job you love, at any company - regardless size, industry and budget. At the same time, we want to make it easier for companies - from startups to multinationals - to hire the right talent to fuel their business. In order to realise this, we offer a range of services through our Platform.
The Platform and Service are provided by Magnet.me (“Magnet.me”).
If the Member resides in the United Kingdom, the Products & Services are provided by Magnet.me Ltd. whose registered office is at 501 The Pillbox, 115 Coventry Road, London E2 6GG, registered under company number 09512507 and VAT-number 228 7358 80.
If the Member resides in the Netherlands or any other part of the world, the Products & Services are provided by Magnet.me NL B.V. whose registered office is at Goudsesingel 200, Rotterdam, registered under company number 63642328 and VAT-number NL.8553.29.993B.01.

Account |
The (primary) means through which a Member has access to the Platform through his/her Login credentials. |

Content |
Any data and information available through the Magnet.me Service or contained within the Website, Platform, presentations, blogs, articles, documents, pictures, images or other informational materials. |

Employer |
An organisation using the Platform for recruitment and/or employer branding purposes. |
|
Login Credentials |
A combination of a Member’s email address and password that gives the Member access to his/her Account. If a Member has registered an Account through his/her account with certain third-party social networking services, like Facebook or Google, this account will serve as Login Credentials. |

Magnet.me Materials |
The visual interfaces, graphics, design, systems, methods, information, computer code, software, services, “look and feel”, organisation, compilation of content, code, data and all other elements of the Magnet.me Services. |

Member |
The natural person who has accepted these Terms. |

Member Data |
Files and any other digital data and information, which is uploaded to the Platform by a Member. |

Platform |
The Magnet.me application which is accessible via the Website or via our mobile applications. |

The Website, Platform, Content and all content, services and/or features available through the Platform. |

When accepted by you (as defined above), these Terms form a legally binding contract between you and Magnet.me.
In the event that you not agree with (parts of) these Terms, then you may submit a written request to Magnet.me for different provisions. This can be done by sending an email to info@magnet.me.
Magnet.me reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms by posting such changes on or through the Platform or the Magnet.me Service. Please check these Terms periodically for changes. Your continued use of the Magnet.me Service after such changes have been posted (as provided above) constitutes your binding acceptance of such changes. Such amended Terms will automatically be effective upon the earlier of (i) your continued use of the Magnet.me Service, or (ii) 30 days from posting of such modified Terms on or through the Platform. Notwithstanding the foregoing, the resolution of any dispute that arises between you and Magnet.me will be governed by the Terms in effect at the time such dispute arose.
Magnet.me will make the Magnet.me Service available to a Member pursuant to these Terms.
Magnet.me will maintain administrative, physical and technical safeguards for protection of the security, confidentiality and integrity of Member Data. Those safeguards will include, but will not be limited to, measures for preventing access, use, modification or disclosure of Client Data by Magnet.me personnel except (a) to provide the Magnet.me Service and prevent or address service or technical problems, (b) as compelled by law or (c) as a Member expressly permit in writing.
By agreeing to these Terms, a Member grants Magnet.me a general authorization in the meaning of Article 28 (2) of Regulation (EU) 2016/679 to engage processors for the purposes of providing the Magnet.me Service. Magnet.me will inform the Member of changes in such processors in accordance with the procedure of modifying these Terms as stipulated in section 4 of these Terms.

Certain features, functions, parts or elements of the Magnet.me Service can be used or accessed only holders of an Account. The person who wishes to create an Account must:
From the moment the person completes this process is considered a Member.
A Member warrants to Magnet.me a guarantee that all the information that a Member has entered in the sign-up form and/or uploads to the Platform (Member Data) is accurate and true. If Magnet.me has a valid reason to believe that the information that provided by a Member is incomplete, untrue, misleading or incorrect, then it is entitled to delete the information and if it so wishes, to terminate the Account of the concerning Member entirely.
It is not allowed to create an Account under someone else’s name unless this person has given permission to do so.
A Member is responsible for the confidentiality of his/her password, which gives access to his/her Account. It is not allowed for a Member to grant access to his/her Account to any third party organisation under any circumstances.
An Account is assigned to a designated individual person and is not transferable.
A Member may terminate his/her Account by following the designated steps after clicking “Delete my profile” in the “Personal settings” section of the Platform. Magnet.me will delete all Member Data following the termination of his/her Account.
Magnet.me has the right to terminate a Member’s Account for no or any reason, at any time, with or without notice.
Only students that are older than 16 years old are eligible to use the platform.
A Member is not allowed to use the Website and/or Platform:
The Magnet.me Service, Magnet.me Materials, Magnet.me trade names and trademarks, and any parts or elements thereof are solely and exclusively owned and operated by Magnet.me. Any commercial or promotional distribution, publishing or exploitation of the Magnet.me Materials is strictly prohibited unless you have received the express prior written permission from Magnet.me. Magnet.me reserves all rights to the Magnet.me Service, Magnet.me Materials and Magnet.me trade names and trademarks not expressly granted in the Terms.
It is explicitly prohibited to download, copy, alter or make public any files, software or materials, including the Magnet.me Materials, that are available on the Website and/or Platform.
It is prohibited to alter the source code of the Website, to use it as the basis for any work or to try to retrieve the source code in any way or sell, vest, sub-license, transfer or establish any right on the information or source code.
Magnet.me takes the privacy of its Members very seriously. Magnet.me’s Privacy Policy at magnet.me/privacy is hereby incorporated into these Terms by reference. Please read the Privacy Policy carefully as it governs Magnet.me’s collection, use, process and disclosure of Member’s personal information.
Magnet.me provides the Website, Platform and Service on an “as is” basis and gives no representation, conditions, warranties or other terms of any in kind in respect of the Magnet.me Service whether express or implied, including, but not limited to, implied warranties of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement.
Magnet.me accepts no liability for any damage following from the use of the Website, Platform and/or Magnet.me Service.
These Terms are governed by Dutch law.
In the event of a conflict between a Member and Magnet.me that cannot be settled or concluded in any other way, the only designated court is the authorized court in Rotterdam.
If any provision of these Terms is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions shall not be prejudiced.
