The Privacy Counsel, as a member of Philips Central Legal Privacy Function is responsible for participating in the development of Group-wide privacy and data protection principles, policies and practices as well as their implementation within a business group or function. The Privacy Counsel is responsible for advising global business group(s) or function(s) on legal and strategic matters surrounding privacy/data protection, as well as for reviewing the privacy controls and practices with regard to all relevant products, services, processes, solutions, systems and architecture to ensure compliance with privacy and data protection laws. The Privacy Counsel will apply knowledge of international privacy laws and regulations to act as privacy legal advisor to an assigned business or functional group. This position requires core legal knowledge, reasoning and judgment, combined with very strong written and verbal communication skills and a practical, solution-oriented mindset.

You will be responsible for

  • Acting as privacy legal point of contact for the appropriate business and functional leaders and their teams and inform them of their privacy compliance obligations pursuant to Philips’ privacy policies and applicable data protection law.
  • Identify personal data processing activities carried out by the relevant business or function assigned to you and execute privacy compliance assessments (when required). Maintain up to date processing registry (Controller and Processor) of the relevant business or function. Drive and embed privacy by design controls into the business processes, quality management systems, products and propositions of your relevant business or function.
  • Support the implementation of the Central Privacy Compliance Program to facilitate compliance of the relevant business or function assigned to you with Philips Privacy policy/standards and applicable data protection laws. Provide expert support and consultancy to promote and facilitate privacy compliance.
  • Implement, oversee and monitor Central Privacy Compliance Program activities such as policies and procedures; standards; guidelines; and tools within the relevant business or function assigned to you. This also includes drafting and supporting the implementation of privacy notices, consent statements, data retention standards and other privacy compliance controls within your relevant business or function. This also necessitates keeping abreast of changes in the privacy and data protection landscape, understanding implications of such changes on your business(e)s or function(s), advising on risks and appropriate mitigations as required to ensure business continuity without compromising privacy compliance.
  • Identify specific training needs within your business(es) or function(s) create, review and/or tailor and deliver privacy training to the Responsible Executives (or their delegates) and to relevant personnel of such business(es) or function(s).
  • When required by internal standards/procedures, provide privacy legal support in the due diligence of third parties (e.g., while selecting third party Processors or during M&A transactions).
  • Upon request, provide privacy compliance support in case of personal data breaches within the scope of the business(es) or function(s) assigned to you.
  • Upon request, provide privacy compliance support for the fulfilment of data subject requests (or privacy-related complaints) related to the relevant business(es) or function(s) assigned to you.
  • Work effectively and built trust with any internal stakeholders necessary to fulfil the above tasks.
  • When needed, participate in the improvement of the Central Privacy Compliance Program by actively leading or working within a team project (e.g. for the implementation of a new privacy law in the relevant business or function assigned to you), providing feedback and/or recommending enhancements.

You are a part of

You will be part of the legal department, and will closely collaborate with other privacy legal counsels, privacy champions, our businesses and functions.

To succeed in this role, you’ll need a customer-first attitude and the following

  • U.S. JD or EU LLB, and/or LLM.
  • A minimum of 3 years’ post qualification experience with a focus on privacy and data protection.
  • Comprehensive knowledge of EU and U.S. data protection regulatory requirements.
  • Experience advising in the digital marketing, e-commerce and advertising technology space.
  • Experience advising on mobile apps and connected systems.
  • Ability and willingness to take practical, and if necessary, bold decisions under time pressure.
  • Ability to work on complex matters independently, as well as in a team, and propose creative solutions in challenging situations.
  • Excellent client management, ability to collaborate with cross-functional teams (internal and external) and strong written and verbal communication skills in English. Working knowledge of Dutch is a plus.
  • Ability to organise and prioritize, with a focus on continuous improvement in processes and operations of the Central Privacy Compliance Program.
  • Certified International Privacy Professional Certification or equivalent preferred.
  • Willingness to travel to consult with internal or external customers.
  • A friendly attitude and a sense of humour.
