(“Magnet.me”, “we”, “us”) processes personal data when
running its business, including operating its recruitment
and employer branding platform (the “Platform”).
We value transparency and aim to clearly explain:
what personal data we process,
for which purposes,
on which legal bases,
and what rights individuals have.
This Privacy Policy applies to:
visitors of the Platform,
persons who sign up for a job seeker account on the
Platform (“Members”),
representatives, contact persons and users of the
Platform (“Users”) at our clients (“Employers”),
and other individuals whose data we process in
connection with our business operations, such as contact
persons at suppliers (this also includes service
providers, subcontractors and the like) or government
institutions.

Magnet.me acts:
as controller for the processing described in this
Privacy Policy; and
as processor for certain processing activities performed
on behalf of Employers, as described in the data
processing agreement we conclude with the Employers.
3. Categories of Personal Data
Depending on your interaction with the Platform, we may
process the following categories of personal data:
3.1 Member (Candidate) Data
account details (name, email address) – it is obligatory
for the Member to provide this information in order to
create an account;
social media log in data - this is shared with us by
your social media provider when you choose to log in
with your social media account;
profile information;
contact details;
resume information such as education, skills, interests,
and career preferences;
application-related information;
interest based information such as job interest,
location, title, experience;
interaction data (views, clicks, responses);
communication data, such as messages shared with use or
Employers and AI Career Coach contents.
3.2 Employer Contact and User Data*
Typically:
name, business contact details including email address;
account and billing information;
Platform usage data;
interaction data (views, clicks, responses).
* This only relates to personal data of business contacts,
not of Members.
We can receive data about (potential) business contacts from
third parties for customer relation or marketing efforts.
This concerns data like business contact details,
organization, job titles, job information.
3.3 Contact Information Data (when you fill out our contact
form)
name, email address;
personal data in the content of your message.
3.4 Candidates applying for a job at Magnet.me
name, contact details;
resume information such as education, skills, interests,
and career preferences;
picture;
application-related information;
personal data in our communication with candidates.
3.5 Other Contact Persons
Typically:
name, contact details;
organization they work for;
personal data in our communication with contact persons.
3.6 Technical and Usage Data
IP address (only used for security logging);
log files and security data;
cookie and similar technology data (if applicable, more
information about this can be found in our cookie
policy).
4. Purposes
We process personal data for the following purposes:
To allow Members to create and secure their accounts on
the Platform and if they choose to do so: with their
social media log-in;
To allow Members to use the functionalities of the
Platform, including uploading their resume information,
sharing this information with Employers, connecting and
communicating with Employers (Employers can also contact
Members who are interested in them), receiving matching
vacancies, using AI agents to train for job
applications, signing up for talent networks;
So that we can operate and maintain the Platform
including matching Members and Employers, recommending
vacancies to Members, showing relevant content,
analyzing the use of the Platform, improving the
Platform and our services, securing the Platform,
preventing malicious use of the Platform (e.g. by bots
creating fake accounts), helping Users with issues or
questions;
To send Members and Users service and legal
notifications with respect to the Platform;
To communicate with Members and Users with respect to
our services (e.g. for support);
To analyze how the Platform is used, by measuring the
access and traffic on the Platform and making navigation
reports, for the purpose of improving and optimizing the
Platform;
To analyze and aggregate Platform usage and interaction
data, for example to show how many Members were
recruited through the Platform, to identify social,
economic or employment market trends such as which
studies are most sought after, to show to Employers
which universities is most popular with a certain
Employer and to show this aggregated and anonymous data
to the Employers;
If permitted by applicable laws, we share limited
personal data, such as your email address, with social
media platforms such as Facebook, Google, LinkedIn or
TikTok, to generate leads, traffic to our Platform or to
otherwise promote our Platform or Magnet.me;
To conclude and perform the agreement we have with the
Employer and suppliers, including for billing purposes;
To maintain a commercial relationship with our contact
persons at Employers;
To verify and enforce compliance with our terms of
service, the agreement with the Employer, Member or
supplier and/or applicable laws and regulations;
With respect to candidates who apply for jobs with us:
to be able to assess their fitness for the job and go
through the job application process;
If we become involved in a merger, acquisition, sale of
assets or the like, to share data as strictly necessary
in relation to the relevant situation;
To comply with legitimate third-party requests;
To handle legal disputes.
5. Legal bases
We process personal data on the following legal bases:
Our legitimate interests to run our business, namely
maintaining and operating the Platform, matching,
showing recommendations and relevant content, platform
analytics and improvement, aggregation of data,
security, preventing malicious use of our Platform,
compliance, keeping an administration, providing
services and support to Employers and Members,
communicating, sales, marketing (including marketing
efforts through social media as indicated in this
privacy policy) and relationship management, handling
disputes;
For the conclusion and performance of the agreement with
the Employers (in case the Employer is a natural
person), the Members or suppliers;
For the legitimate interests of third parties who submit
requests;
To comply with legal obligations we are subject to;
In specific situations, with your consent.
6. Matching, Recommendations, and Profiling
Magnet.me uses automated processing, including profiling, to
improve the relevance of content on the Platform.
6.1 How profiling is used
When we say we use profiling information, we mean
information based on:
Your resume and profile information (such as your job
function and location);
Interests you indicate on the Platform (such as your
interest in a job in a certain sector);
Your interactions on the Platform (such as your likes of
Employer content).
Profiling can be used to:
Recommend vacancies and Employers that match a Member’s
interests;
Send Members invites to connect to an Employer;
Improve the relevance of Employer content (e.g. if you
want to work in a certain area, vacancies in that area
are shown first).
6.2 Important safeguards
Magnet.me does not take solely automated decisions that
produce legal or similarly significant effects for
Members;
The automated processing does not include special data
categories;
All hiring decisions are made exclusively by Employers;
All vacancies can be found by using the search
functionality on the Platform;
Recommendations are indicative and non-binding.
Members may exercise their rights, including in relation to
profiling, as described in Section 11.
7. Applications and Employer Processing
When a Member applies for a vacancy or otherwise shares
personal data with an Employer:
The Employer processes such personal data as an
independent controller in its own account and Magnet.me
thereby acts as a processor;
The Employer’s own privacy policy applies to this
processing.
8. Recipients of Personal Data
Personal data may be shared:
If you are a Member: with Employers, in the sense that
your profile becomes visible to an Employer as follows:
Your profile is visible to an Employer after you
have liked at least one vacancy of that
Employer;
Your profile is visible to an Employer after
they have approached you;
Your profile is visible to an Employer if you
are in that company’s network;
Your profile is visible to an Employer if you
were sourced for one of that Employer’s active
opportunities;
Profiles are not visible to other Members;
If you are a Member: with Employers when you share your
information (e.g. resume, messages) after you have
connected with them;
With our service providers acting as processors (e.g.
hosting, analytics, customer support);
With the social media provider of your social media
account with which you log in to your account on the
Platform;
With social media platforms for the marketing purposes
indicated under 4 (Purposes), these social media
platforms are controllers;
With third parties in the context of a legal dispute;
With third parties who submit legitimate requests;
With authorities where legally required.
We ensure that processors are contractually bound to
appropriate data protection obligations.
9. Data Location and International Transfers
9.1 Platform and service data
Personal data processed as part of the Platform and services
is stored and processed within the European Economic Area
(EEA).
When a user of the Platform interacts with functionality
offered by OpenAI, for example our career coach chat bot,
personal data can be transferred to OpenAI in this context.
For example if you include your name in the chat. OpenAI
stores personal data outside the EEA on the basis of
standard contractual clauses approved by the European
Commission or adequacy decisions.
9.2 Employer data
Data processed for sales, marketing, commercial relationship
management or support purposes may be processed outside the
EEA.
Where international transfers occur, Magnet.me ensures
appropriate safeguards, such as:
adequacy decisions; or
standard contractual clauses approved by the European
Commission.

10. Retention Periods
We retain personal data only for as long as necessary for
the purposes described in this Privacy Policy.
The retention terms or criteria we use are:
Member data is deleted after they have deleted their
account - the data can stay stored in back ups for a
while but will be deleted when the back up is renewed;
Member data of inactive accounts is stored for 10 years;
Your IP-adress is stored for 90 days;
Logging data is stored for 6 months;
Candidate’s data who apply for a job at
Magnet.me is stored for 4
weeks after the completion of the application procedure
or 12 months with the candidate’s permission;
Contact details of business contacts are stored for the
duration of the business relationship and generally
until 10 years thereafter;
Personal data in our financial administration is saved
for 7 years;
Personal data related to disputes or legal matters are
saved for as long as is necessary to round off the
dispute or matter and generally for 5 years after that.
After the retention term, data may be anonymised and
retained for analytics and statistical purposes.
11. Your Rights
Under the GDPR, you have the right to:
access your personal data;
have incorrect data rectified;
have your personal data deleted;
have your personal data restricted;
object to the processing of your personal data, where
your personal data are used for marketing purposes, we
will cease using your data for these purposes upon your
request;
data portability;
withdraw your consent at any time where processing is
based on consent without affecting the lawfulness of
that processing before your withdrawal.
If you are a Member, you can edit the visibility of your
information on the Platform through the privacy settings in
your account.
Requests can be submitted via the contact details listed
above. Please note that we may be entitled to refuse certain
requests or parts thereof.
12. Complaints
Individuals have the right to lodge a complaint with a
supervisory authority, in the Netherlands: the Dutch Data
Protection Authority (Autoriteit Persoonsgegevens).
13. Cookies and Similar Technologies
We use cookies and similar technologies to operate and
improve the Platform.
Further information is provided in our Cookie Policy (if
applicable) or through cookie banners and settings on the
Platform.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The
most current version will always be available on the
Platform.
